Am I Guilty of Thoughcrimes?

As a conservative teacher, I plead guilty to the worst sort of offense for a public school teacher- thoughtcrimes. I am guilty of thoughtcrimes- I am a conservative teacher even though I do not push or encourage my conservative views and values in my classroom, even though I make conscious efforts to articulate all sides of every debate and situation, even though I play devil's advocate and am critical of all politicians and views at one time or another, and even though I seek primarily to inspire critical thinking.

You see, it is not my actions which threaten liberals and leftists and Democrats- it is my very existence and the fact that I do not quietly acquiescence to their thuggish attempts to convince me to think differently.

In his novel 1984, George Orwell described a thoughtcrime as an illegal type of thought. Liberals and leftists hate and fear me, because while in the classroom I may be a model teacher and may be inspiring and motivating students, in private I am the author of this blog where I state my thoughts and opinions on a range of subjects in a conservative manner, and for that they feel I must be silenced, fired, and perhaps worse.

Increasingly as our nation descends into a totalitarian fascist state, people like me are a threat to the government. Some people might be conservatives or libertarians or Republicans, but they're usually not teachers, and if they are they have been successfully revealed as thus and thus marginalized and silenced already. What really bothers the government and the fascist thugs who run it is that I'm still hidden in the system, unexposed, unsilenced and unmarginalized, and still teaching. I'm still teaching young children the skills of how to think critically. I'm still exposing students to tough questions and hard facts, and them giving them the skills to grapple with them- without telling them what to think about those facts or without answering the questions for them as a liberal leftist teacher would do. I'm still employed, even though I am a conservative and a teacher.

Some teachers inspire a few students to be conservative by accident or just absently are a conservative and a teacher- but I've thought about this beforehand and put forethought into it, showing that I have a plan to teach students how to think and to give them a wealth of information to think on, and I have done all of this knowingly and purposefully- and that's a crime worse than actually pushing my views or indoctrinating students. I'm not just a conservative and a teacher- I am A Conservative Teacher, and that's a threat to liberals and leftists and makes me guilty of thought crimes of the worst sort.

In many ways, thought crime is an even more serious offense than committing an actual crime, and that is why I have inspired such hate and attacks from my comments and blog posts, more so than others who simply are conservatives. Our outward actions and character stem from our inner world, and my inner world is conservative, and thus it does not matter to liberals and leftists what my outer world of teaching is like and how professional I am in that environment- they know and I know they know that I am a conservative teacher.

Many out there, including President Obama and the modern day Democratic Party that has been infiltrated and taken over by liberal fascists, believe that you can practice one thing all you want, but you must think and believe only what the fascist government tells you to believe. And I don't, and that is why I am a threat that they need to silence, intimidate, and threaten.

The good news is that I have for years been lying about who I am- using friends for radio interviews, having family members post my comments and blog posts from their locations, and even mixing up personal details. Since I started this blog in 2008, I've moved three times and worked in two school districts on either edge of town, gotten married, had a dozen kids, and even taken up urban farming! Because I am still unknown, I remain a threat. I'm nearing retirement age though and just need to hold on for a couple more years. And you wolves, although you may circle me, I am a friend of liberty and a patriot, and you will not terrorize me into thinking differently. Two plus two does equal four.

Stiffening the fight against Financial Crime

Abhay Abhay (Advisor to the EFCC of Nigeria) on building local financial crime fighting resources:

“To investigate a case of inexplicable wealth, an investigator needs to know laws, rules and practices, not only when it comes to corruption and crime, but also in a number of other areas – the purchase and sale of property and vehicles, establishing and dissolving companies, dealing on the stock exchange, the code of conduct for public officials, income tax and so on.”...investigators must also learn cultural and social practices that affect consumption, spending, investment and the presentation of gifts.

Obama On Inner and Outer Circles of Leadership

In The Man Who Was Thursday: A Nightmare (Penguin Classics), by G.K. Chesterton. Chesterton describes anarchists this way:

This is a vast philosophic movement, consisting of an outer and inner ring. The outer ring- the main mass of their supporters- are merely anarchists; that is, men who believe that rules and formulas have destroyed human happiness. They believe that all the evil results of human crime are the results of the system that has called it a punishment. They do not believe that the crime creates the punishment. They believe that the punishment has created the crime. These people talk about 'a happy time coming,' 'the paradise of the future,' 'mankind freed from the bondage of vice and the bondage of virtue,' and so on.

And so also the men of the inner circle speak. But in their mouths these happy phrases have a horrible meaning. They are under no illusions; they are too intellectual to think that man upon this earth can ever be quite free of original sin and the struggle. And they mean death. When they say that mankind shall be free at last, they mean that mankind shall commit suicide. When they talk of a paradise without right or wrong, they mean the grave. They have but two objects, to destroy first humanity and then themselves.
In my post Book Review: The Man Who Was Thursday I noted that:
Chesterton might have called them anarchists or philosophers, and later they might go by other names like fascist or communist, but to me, their ideas about economic suicide for no reason, their dislike of labeling things right and wrong, and their views on life and mark them as the modern Democratic Party. And at the center of the inner circle there is a man who speaks to applauding crowds and says pleasing phrases, but he is under no illusions, and his actions have terrible consequences for our great nation.

The idea of an inner circle of committed revolutionaries surrounded by an outer circle of people who are more moderate in their views is an idea that I have never read or heard about before. Reading it in Chesterton's book was the first time I had ever even thought about viewing the world in this way.

President Obama, on the other hand, jumps quickly to viewing the world this way, and in a classic case of the pot calling the kettle black he has ascribed his personal world view to his enemies, the American people who go to Tea Parties.

Via The Politico story Obama dissects demonstrations:
Obama describes tea party movement this way: "There's some folks who just weren't sure whether I was born in the United States, whether I was a socialist. So there's that segment of it, which I think is just dug in ideologically." "Then," he continued, "I think that there's a broader circle around that core group of people, who are legitimately concerned about the deficit, who are legitimately concerned that the federal government may be taking on too much."

Obama sees in the Tea Party movement structure and order that he is familiar with- an inner circle preaching bad things, and an outer circle who are being fooled into following the movement, but both circles are bad and wrong and do not have legitimate views.

Now, I've been to Tea Parties (see my posts Best State of the Union Address Ever, My Report from the Birmingham Healthcare Rally, or Report from Peters Townhall Sept 09) and to be honest, I don't have the slightest freaking clue what Obama is talking about. I saw the core of Tea Parties as people with legitimate views about spending and government power, and a couple hanger's on who even Tea Party people didn't like who talked about Obama's birth certificate and who waved posters of Obama as Hitler. But, there was no inner and outer core of organization to the Tea Parties- they are just masses of concerned patriots who are trying to make the world a better place.

On the other hand, let's take a look at the Democratic Party... it increasingly is attempting to centralize all decisions with Pelosi, Reid, and Obama, Democratic members of Congress increasingly have 95% party line voting records (like my Congressman Peters, who is as far from moderate and independent as possible), and money that flows into the Democratic Party increasingly flows to the inner circle and then out again. That party, as it is increasingly becoming, is an inner circle of men preaching destruction (pro-abortion, pro-economic destruction, anti-allies, pro-war) surrounded by an outer circle of people duped and who chant hope and change and say the most naive and stupid ideas about the role of government in making people better.

The Democrats fit Obama's narrative better than the Tea Party movement- an inner core of devoted liberals surrounded by a mass of weak willed 'Blue Dogs' who follow orders when push comes to shove.

Not Being Safe Enough is Crime Enough for Canadian Police

Via theglobeandmail:

Anyone who has ridden an escalator and bothered to pay attention has seen and likely ignored little signs suggesting riders hold the grimy handrail. But in Montreal's subway system, the friendly advice has taken on the force of law, backed by a $100 fine.

Bela Kosoian, a 38-year-old mother of two, says when she didn't hold the handrail Wednesday she was cuffed, dragged into a small holding cell, and then fined. She was riding an escalator down to catch a 5:30 p.m. subway when an officer instructed her to hold on to the rail. She replied, “I don't have three hands.” (she was holding other items). That's when the officer demanded identification so he could write her ticket.

Ms. Kosoian started arguing. The officers handcuffed her and threw her into a small holding cell. The officers searched her bag and gave her a $100 ticket for failing to hold the banister and another $320 ticket for obstruction of justice. The handcuffs bruised Ms. Kosoian's wrists and an officer's boot scraped skin off the top of her foot.
Sometimes when we are talking in my class about how bad America has gotten, my kids say that they'll just go somewhere else. "Where?" I ask, and they always say Canada. No offense to our northern neighbors, but your country is worse than ours is, even though ours has been getting totalitarianism too. Freedom, liberty, and justice are fragile flowers struggling against the forces of tyranny and injustice, and most of the times they lose. Here, in Canada, we have a great example of how Canada is worse than the USA.

A law abiding citizen is harassed, injured, insulted, and fined for not holding a safety rail. What crime did she commit? If she had indeed injured herself, so what? It is a far greater crime to give the police the kind of power they displayed here than it is for a person or two to be injured riding the escalator. Remember that, next time there is a vote to give more power to our government for 'our safety'- the greatest threat to your safety is the Frankenstein monster of a government that you yourself created.

Book Review: The Man Who Was Thursday

Recently I read The Man Who Was Thursday: A Nightmare (Penguin Classics), by G.K. Chesterton. I've heard a lot about Chesterton, and have always wanted to read some of his stuff, and I would still suggest reading something he has written, but probably not this book to start. Although it is good, the longer the book goes, the less good it gets, and the ending to me felt like I had to read it 10 times just to say 'oh, I get it now, clever'- not the kind of ending that will stand out in your mind. That being said, it was a good book, and had some good parts to it.

The book takes place in 1900 London, and focuses on a policeman who is fighting anarchists. He manages to get himself elected to the anarchists council, where each person is called by a day of the week. Our hero is called Thursday, and he schemes to stop and expose the other anarchists, including the man bad guy, Saturday. Through this surreal plot and the nutty characters, Chesterton comments on moral relativism and nihilism, and this is the best stuff in the book.

The main character, Gabriel Syme, is a guy who I sort of understand. He grew up in a home where 'change' was the mantra of the day, where his parents were beholden to progressive ideas, and where the whole family attempted to portray sophistication and rebellion. And as time went on Syme began to see how revolting this behavior was, how demented and sad these people were, and so he himself revolted to sanity. He ran from change and progressivism to common sense, to law, to gentle and courteous behavior.

I understand Syme- as our society embraces 'change' and values are lost, MTV grows more lewd, Micheal Jackson is a 'hero', not eating meat and smoking drugs is embraced, and our culture becomes more progressive, I personally am increasingly revolted. When I was younger, I was less conservative, I was more moderate- but this revolting behavior of our society is causing me to revolt against it, and to embrace traditional values, to have more common sense, and to be a better person, much like Syme was.

Chesterton, like other great authors like Orwell, understood the way the world works and understood how tyranny and oppression develops. Remember 1984 and Animal Farm- the dangerous characters, those that were bad and evil, were not the uneducated country boys who believed in private ownership and conservative values. The dangerous, evil, and bad characters were the educated, sophisticated, moral relativistic, and value free ones.

So it goes with Chesterton. As Syme talks with a policeman in Chapter 4, the policeman says:

(The anti-anarchist police) deny the snobbish English assumption that the uneducated are the dangerous criminals. We remember the Roman Emperors. We remember the great poisoning princes of the Renaissance. We say that the dangerous criminal is the educated criminal. We say that the most dangerous criminal now is the entirely lawless modern philosopher.

Compared to him, burglars and bigamists are essentially moral men. They accept the essential idea of man; they merely seek it wrongly. Thieves respect property; they merely wish the property become their property that they may more perfectly respect it. But philosophers dislike property as property; they wish to destroy the very idea of personal possession. Bigamists respect marriage, or they would not go through the highly ceremonial and even ritualistic formality of bigamy. But philosophers despise marriage as marriage. Murderers respect human life; they merely wish to attain a greater fullness of human life in themselves by the sacrifice of what seems to them to be lesser lives. But philosophers hate life itself, their own as much as other people's.

The common criminal is a bad man, but at least he is, as it were, a conditional good man. He says that if only a certain obstacle be removed- say a wealthy uncle- he is then prepared to accept the universe and praise God. He is a reformer, but not an anarchist. He wishes to cleanse the edifice, but not to destroy it. But the evil philosopher is not trying to alter things, but to annihilate them.

Yes, the modern world has retained all of those parts of police work which are really oppressive and ignominious, the harrying of the poor, the spying upon the unfortunate. It has given up its more dignified work, the punishment of powerful traitors in the State and powerful heresiarchs in the Church.

I realize that is a long passage, but it was one of the most meaningful in the book, because it conveys that the enemy is indeed a terrible thing, and not because they wear a black mask or have a golden gun, but because of what they themselves believe. As you read that passage, perhaps you understand why Chesterton is so highly regarded- did you get a sense that he was describing someone in our political system?

Chesterton might have called them anarchists or philosophers, and later they might go by other names like fascist or communist, but to me, their ideas about economic suicide for no reason, their dislike of labeling things right and wrong, and their views on life and mark them as the modern Democratic Party. And at the center of the inner circle there is a man who speaks to applauding crowds and says pleasing phrases, but he is under no illusions, and his actions have terrible consequences for our great nation.

Remaking Lagos

Time reports on efforts to turn around the bustling metropolis of Lagos:
Central Business District LagosImage of Lagos via Wikipedia
For Babatunde Fashola (Governor of Lagos state), the law is key. The changes he is overseeing improve infrastructure, create jobs, make money, even build him a soaring political career. But ultimately, the aim is to end the anarchy, he says. A city that does not function "creates desperate conditions for people and reduces their ability to resist temptation." Lapses can be minor, like driving on sidewalks or into oncoming traffic, or major, like violent crime. Fashola sees both as symptoms of Lagos' dysfunction, and he is tackling them by, in one approach, setting up a series of driver-improvement schools as well as, in another tack, employing area boys as cleaners and gardeners to beautify their neighborhoods. It's working. Orderly lanes are becoming the norm on the roads. And crime is down. From 2007 to 2008, armed robberies in Lagos fell 89%. From 2008 to 2009, car theft fell 54%. And murder more than halved, from 221 cases in 2007 to 94 in 2010. This rising sense of citizenship is revealing itself in another surprising way. Astonished then delighted by the transformation their new governor was effecting, Lagosians were happy to pay for it. By 2010 the governor was raising 70% of the state's income locally from taxes. By diminishing the importance of oil money handed out by the federal government and raising the role of local tax, Fashola has reconnected the state to its people. He takes that as a stamp of approval for his efforts to reverse lawlessness in government as well as across the city. "The capacity of a government to attract taxes is a very strong measure of its legitimacy,"

Make 'Patrimonicide' an International Economic Crime

Ndiva Kofele writes:

I have somewhat immodestly taken the liberty of inventing the word ‘patrimonicide’ as the name for this new international economic crime. The word comes from combining the Latin words ‘patrimonium’ meaning “[t]he estate or property belonging by ancient right to an institution, corporation, or class; especially the ancient estate or endowment of a church or religious body” and, of course, ‘cide’ meaning killing. It is submitted that indigenous spoliation is the very essence of the destruction (or killing, if you please) of the sum total of a nation's endowment; the laying waste of the wealth and resources belonging by right to her citizens; the denial of their heritage.

Obama's Myth on Gitmo Joins Collapse of Other Myths of Left

"A system of morality which is based on relative emotional values is a mere illusion, a thoroughly vulgar conception which has nothing sound in it and nothing true" Socrates once said. Over the past two years, much of the narrative of the left has been demonstrated to be nothing more than a mere illusion, a vulgar conception of reality that increasingly is proven to be untrue. Once the left seized power on in our nation, on most major policies they have simply continue the policies of 'conservative' George W Bush, who they emotionally railed against for 8 years, while adding to it other leftist policies that are bound to also be proven wrong. Whether it has been continuing the War on Terror, not withdrawing from Iraq or Afghanistan, continuing tax cuts, or keeping in place 'Don't Ask Don't Tell', the left has discovered that while spinning an illusion might fool voters into putting them in power, once in power reality hits and they no longer are able to indulge in their childish fantasies.

Just last week, reality rose up again and once again dispelled a major part of the illusion of the left- that of an evil Gitmo prison holding innocent goatherders that lawless George Bush ran to the detriment of the world and United States.

From The Wall Street Journal's article The Collapse of the Guantanamo Myth:

...For two years, President Barack Obama has pretended that terrorism is a crime, that prisoners are unwanted, and that Gitmo is unneeded. As a presidential candidate, he declared: "It's time to show the world . . . we're not a country that runs prisons which lock people away without ever telling them why they're there or what they're charged with." Upon taking office, he ordered Gitmo closed within the year.

But the president's embrace of the left's terrorism-as-crime theories collided with his responsibility to protect a great nation. Now the reality of the ongoing war on terror is helping to shatter the Gitmo myth and end its distortion of our antiterrorism strategies....

...All of this is having an impact on Congress, which this week voted overwhelmingly to de-fund any effort to shut down the Gitmo prison. It also barred the Justice Department from transferring detainees to the U.S. homeland...
Look, I've been in Michigan, which in 2002 decided to embark on a program of hope and change under Democrat Governor Jennifer Granholm. As she promised and talked, she put in place regulations, taxes, and schemes that resulted in a single state recession and some of the worst economic statistics in the nation. The illusion of her leftist beliefs met reality, and instead of facing that reality, she double-downed on leftist ideas, raising taxes in the midst of a recession, increasing regulation of businesses, attacking productive companies with taxes, and so forth. And the reality was a worse economy.

Reality is what it is, and although it is possible to change reality, you can't wave a magic wand of liberalism at it and hide it in illusions. Obama found on entering office that much of his belief system, much of what the American people bought, was based on illusions and myths. Obama was a child, lacking experience in business or government, uneducated about a great many things including history and economics and philosophy, whose ideas of the world were not reality. But once faced with reality, he has tried desperately to reconcile it with his existing ideas- jamming continuing the war and continuing tax cuts with Obamacare and cap-and-tax- in the hope that he was not completely wrong about almost everything.

But he is- on a range of issues, time is going to demonstrate that it was Reagan who made the economy boom in the 80's, it was the GOP Revolution of '94 that made the economy boom in the 90's, it was Bush who made the economy positive in the early 00's, and that it was Democrats and their leftist policies that drove our economy into recession, and then Obama and his policies that deepened and lengthened a recession into a depression. That's the narrative that's reality.

UPDATE: The following are not myths- they are real pieces of advice for you that you really show follow:
  • In the event of that some is decapited, what you do is sit the victim's body in a chair as best you can, balance the head on top of the shoulders, and walk away whistling nonchalantly.
  • You should always keep plenty of gauze around the house in case you invent an invisibility potion.
  • In the event that someone you know sufferes a stroke, give them an eye-popping orgasm- it is always appreciated, no matter the situation.
  • If someone you know is seriously injured, cradle his or her head in your lap and scream, "Why?"
  • Make sure your first-aid kit always contains a large, frilly Victorian fan to revive fainting victims.
  • If you are a hideous, disfigured hunchback and you see someone who is injured and unconscious, treat the person. Then, as the person begins to wake up, retreat into hiding. The person will always wonder who saved him or her, and the experience will be poignant in a bittersweet way.
  • If possible, try to be the guy who tells the victim, "Everything's going to be all right," while others do the actual work.

1930's Are Root of All That is Wrong

The last time our nation had such a progressive President was back when FDR ran the US through the Great Depression, and not surprisingly, that's the last time we had a recession last this long and this deep. It was during the 1930's that communism and fascism were popular around the world. And it was during this time when the Republicans were discredited by the trauma of the stock market collapse and the start of the Depression, and so Democrats under FDR could put in place all of their progressive policies.

At one time, I thought the 1930's were at the root of all that is wrong about America, and compiled a list of all of the laws and taxes and liberal decisions passed during that time. For history's sake, here is that list:

Unemployment Compensation Tax (MI), 1936
Oil and Gas Severance Tax (MI), 1929
Horse Race Wagering Tax, (MI), 1933
Sales Tax (MI), 1933
Use Tax (MI), 1937
Beer Tax (MI), 1933
Wine Tax (MI), 1933
Intangibles Tax (MI), 1939
Commercial Forest Tax (MI), 1925
Gasoline Tax (MI), 1925
Diesel Fuel Tax (MI), 1947
Motor Carriers Privilege Tax (MI), 1923
Aviation Gasoline Tax (MI), 1929
Aircraft Weight Tax (MI), 1923
Employment Security Act (MI), 1936
Social Security Act (USA), 1935
Wagner-Peyser Act (USA), 1933
Fair Labor Standards Act (USA), 1938
US v Miller (US Supreme Court), 1939
National Firearms Act (USA), 1934
Federal Reserve Act (USA), 1913
Motor Carrier Act (MI), 1933
Smoot-Hawley Tariff Act (USA), 1930
Crime Control Laws (USA), 1934
Hoover Tax Hike (USA), 1932
Amendment 16 (USA), 1913
Amendment 17 (USA), 1913
Baron-Davis Act (USA), 1931
National Labor Relations Act (USA), 1935
Walsh-Healy Act (USA), 1936
Copeland Act (USA), 1934
Food, Drug, and Cosmetic Act (USA), 1938
Michigan Labor Unions, Act 176 of 1939 (MI), 1939
Private Schools, Act 302 of 1921 (MI), 1921
Insurance Regulation, Act 66 (MI), 1933
Regulation of Hospitals, Act 108/109 (MI), 1939
Roosevelt moves traditional Thanksgiving Day, 1939
Regulating Firearms, Act 373 (MI), 1927
Liquor Control Act, PA 8 (MI), 1933
Sidewalk Regulation, Act 246 (MI), 1931
Government ownership of sewers, Act 316 (MI), 1931
US moves off gold standard, 1933
Ownership of private gold now a crime, 1933
State Printing Act, Act 153 (MI), 1937

Look through that list and think of how much America was changed by one generation, by one President, by one party, by one decade (mostly). What the heck happened to allow that? The rise and influence of communism and fascism? Trauma from WWI? Some sort of generational cycle? Did something happen to the children in 1900 so they were fools when they came to power in the 1930's? Was it just Great Depression freak out? The lack of expansion of our borders? The rise and feminization of society? Some new invention? A religious movement? Something in the water? Email me if you have any theories.

UPDATE: Also add Reapportionment Act of 1929 to the list.

AU: Pushing for Conservatives of Color

One of the biggest problems facing the Republican Party is the perception that it is not welcoming to minority groups. To many Republicans, this upsets us- after all, our party freed the slaves, our party fought against slavery, our party fought the racial segregation in the south, our party passed the Civil Rights bills over Democrat's objections, and our party today pushes an agenda that minority groups should support.

The Republican Party has pushed for educational reform and accountability- not to help out the rich kids in the white schools, but to help out those stuck in failing schools in predominantly urban areas. The Republican party has pushed for welfare reform- not to hurt minority groups but to help them to gain dignity and freedom by moving off of the welfare rolls of the state to making their own living in this world. The Republican Party pushes for more crime fighting and tougher punishments on criminals, ideas that should be winning in communities that sadly have higher rates of crime. The Republican Party is the party that fights the drug culture that is so corrupting to the inner cities and minority communities. The Republican Party fought against raising the minimum wage, which studies have shown cause higher unemployment in minority groups. On issue after issue, it is Republicans who are pushing policies and ideas that would benefit minority groups, and yet the perception remains that Republicans and their ideas are wrong.

This is partly the own fault of the Republican Party, and efforts need to be made to change this perception. Akindele Unleashed discussed this in a recent column-read the full column by linking here- here are some highlights:

However, it seems like the biggest challenge is how Republicans can approach urban areas. The answer is simple. Just talk about issues that are relevant. I think I brought this up several times in our discussion. Instead of template talking points and foreign platforms I stressed the need for discussions on mental health, family building, global education, and even participating in race relation discussions. The key here is relationship building.

We know the GOP has ties with various Chamber of Commerces across the State of Michigan but are we partnering with other community based groups who have direct access to people in our community? When was the last time the GOP connected with Focus Hope? The North Oakland Republican Club volunteered to work in a soup kitchen in Pontiac not too long ago. Most GOP clubs will not even conduct meetings in urban communities. That alone shows the disconnect.

Civic education forums are needed to inform constituents on the issues as well as creating solutions. I said nothing about bashing elected officials. I said solutions. If the GOP becomes more solution-oriented we will see a positive outcome in urban communities.
Akindele hit on a couple important ideas that Republicans should be well aware of- relationship, making the effort to reach out, and focusing on solutions. Every Republican can should heed this advice- they can not afford to not to if they want to help out minority groups in our nation.

CATO: Quick Status Check on Bill of Rights

As a conservative who fights for liberty and freedom, I have been unhappy with the attacks of our civil liberties that have dramatically escalated in the recent years since President Obama and the liberal Democrats have gained more political power. These left-wing groups pretend to care about civil liberties- but unlike under Bush when the conversations were hypothetical (what if we waterboard more than one person, what if the Patriot Act is abused, etc), under Obama the attacks on civil liberties are real and dangerous. Since yesterday was the anniversary of the Bill of Rights (the first 10 amendments to the US Constitution came into effect on December 15, 1789), via Cato let's get a quick update on how these amendments are being violated.

To see all of the links, check out the full article at Today Is Bill of Rights Day:

The First Amendment says that “Congress shall make no law… abridging the freedom of speech.” Government officials, however, have insisted that they can gag recipients of “national security letters” and censor broadcast ads in the name of campaign finance reform.

The Second Amendment says the people have the right “to keep and bear arms.” Government officials, however, make it difficult to keep a gun in the home and make it a crime for a citizen to carry a gun for self-protection.

The Third Amendment says soldiers may not be quartered in our homes without the consent of the owners. This safeguard is one of the few that is in fine shape — so we can pause here for a laugh.

The Fourth Amendment says the people have the right to be secure against unreasonable searches and seizures. Government officials, however, insist that they can conduct commando-style raids on our homes and treat airline travelers like prison inmates by conducting virtual strip searches.

The Fifth Amendment says that private property shall not be taken “for public use without just compensation.” Government officials, however, insist that they can use eminent domain to take away our property and give it to other private parties who covet it.

The Sixth Amendment says that in criminal prosecutions, the person accused is guaranteed a right to trial by jury. Government officials, however, insist that they can punish people who want to have a trial—“throwing the book” at those who refuse to plead guilty—which explains why 95 percent of the criminal cases never go to trial.

The Seventh Amendment guarantees the right to a jury trial in civil cases where the controversy “shall exceed twenty dollars.” Government officials, however, insist that they can impose draconian fines on people without jury trials.

The Eighth Amendment prohibits cruel and unusual punishments. Government officials, however, insist that a life sentence for a nonviolent drug offense is not cruel.

The Ninth Amendment says that the enumeration in the Constitution of certain rights should not be construed to deny or disparage others “retained by the people.” Government officials, however, insist that they will decide for themselves what rights, if any, will be retained by the people.

The Tenth Amendment says that the powers not delegated to the federal government are reserved to the states, or to the people. Government officials, however, insist that they will decide for themselves what powers they possess, and have extended federal control over health care, crime, education, and other matters the Constitution reserves to the states and the people.

It’s a disturbing snapshot, to be sure, but not one the Framers of the Constitution would have found altogether surprising. They would sometimes refer to written constitutions as mere “parchment barriers,” or what we call “paper tigers.” They nevertheless concluded that having a written constitution was better than having nothing at all.

The key point is this: A free society does not just “happen.” It has to be deliberately created and deliberately maintained. Eternal vigilance is the price of liberty. To remind our fellow citizens of their responsibility in that regard, the Cato Institute has distributed more than five million copies of our pocket Constitution. At this time of year, it’ll make a great stocking stuffer. Let’s enjoy the holidays but let’s also resolve to be more vigilant about defending our Constitution.

Going After AIG Could Violate Constitution Clause Prohibiting Bills of Attainder

If your high school government teacher did his/her job, you learned that the Constitution prohibits bills of attainder. A bill of attainder is an act of legislature declaring a person or group of persons guilty of some crime and punishing them without benefit of a trial. Bills of attainder are forbidden by Article I, section 9, clause 3 of the United States Constitution.

The Democrats in Congress are now upset that the money that they gave AIG was used to provide bonus' for executives, and are going to be introducing legislation in Congress soon that will target these specific executives for punishment. As Democratic Senator Claire McCaskill wrote:

Legislation Will be introduced in the next 48 hours or so that will tax these companies and the bonus recipients. The tax will be aimed at executives at companies that have received significant taxpayer assistance through the TARP funds and will recover almost all of these funds for taxpayers. I feel better. We are taking action. It’s time we right this wrong on behalf of hard working Americans everywhere.
In other words, our government is targeting persons or groups of persons, declaring them guilty of a crime (giving out a retention bonus agreed on in contracts), and punishing them by taxing them to reacquire the money that Congress gave them. Doing this, which even though I'm no lawyer, appears to violate the Constitution, makes her 'feel better.'

Things are spiraling out of control very quickly now, and you can pick virtually any clause in the Constitution, no matter how obscure, and I bet the Democrats are at work right now trying their best to violate it. I'm not happy about executives getting a bonus during these tight times, especially when they may have played negative role in their business, but I still believe in a limited government. Democrats apparently don't, and if they don't believe in those ideas in the Declaration of Independence, you have to wonder what other ideas in the Declaration do they not believe in.

More on the legality of a legislative bill that would tax the AIG executives bonus' can be found at The Heritage Foundation's website.

UPDATE: If you were expecting the Congress to respect the Constitution or the Courts to step in and make sure we are still following the Constitution, prepare to be disappointed. Apparently, contemporary legal minds trained in our top law schools now feel that the national government does have the power to single out groups of people it doesn't like and tax them money they earned in the past because it doesn't like them. For more details evaluating the legal arguments here, I direct you to The Volokh Conspiracy and this post.

Armenian Genocide Remembrance Day

Yesterday was Armenian Genocide Remembrance Day (April 24). The word ‘genocide’ is a recent word that means destroying, either in whole or in part, a national, ethnic, racial, or religious group. This can be done by killing them all off, deliberately inflicting on the group conditions of life that are calculated to kill them off, imposing measures on the group intended to prevent births by the group, forcibly transferring children of the group to another group, and trying to breed the group out of existence by raping the women of the group.

The 20th Century has a brutal legacy of genocide, and it all started with the Armenian Genocide from 1915-1923. Before Darfur (current day), before Bosnia (1995), before Rwanda (1994), before Cambodia (1975-1979), before the Nazi Holocaust of Jews and Poles and Gypsies (1938-1945), and before the Ukrainian Famine, there was the Armenian Genocide. Hitler once justified his Holocaust by asking “Who, after all, speaks today of the annihilation of the Armenians?”

In the Armenian Genocide, more than 1.5 million Armenians were killed out of 2 million. The main reason for this was a desire to ‘Turkify’ the Ottoman Empire and kill off all non-Muslims (Armenians were largely Christian). Armenian men were drafted into the army to fight WWI- and then were disarmed and put into labor camps, where they were soon starved or killed. Groups of government officials spread rumors of the Armenians betraying Turkey, blamed them for the losses Turkey was suffering during WWI, and demanded ‘justice.’ In April 24, 1915, all community leaders were systematically rounded up and put to death. After that, as WWI spread and became more confusing and disorganized, armed groups would come into Armenian villages and kill off the rest of the men or make them go on death marches, rape or carry off the women to use as slaves, kidnap or enslave the children, loot the village of all valuables, and then chase off remaining Armenians (who then later died of starvation, exposure, or brutality). By 1923, Armenian was simply a memory- 4000+ years of history wiped away like it never existed- churches, monasteries, schools, people, possessions were all destroyed or gone. Even the Armenian names of cities, villages, and rivers were changed.

The official line in Turkey is that the number of people that died has been grossly inflated, and the evidence of this genocide comes from dubious and prejudicial sources. Turkey claims that more Muslims than Christians died during the same period in the chaos that engulfed Turkey during and after WWI. Turkey says that Ottoman officials were tried for crimes against the Armenians and were acquitted, and that the word ‘genocide’ wasn’t even around until after WWII, and that the Holocaust isn’t anything like what happened in Turkey to the Armenians. In 2004, Turkey passed Article 301, which makes it a crime to even talk about the Armenian Genocide, and Turkey today spends millions lobbying the US to try to defeat efforts here in the US to recognize the genocide. Turkey even gives millions to prestigious universities to fund studies of the ‘Turkish view’ of the genocide and offers scholarships to people who will write books or articles denying that the genocide ever took place.

Typical for the waffling spineless President that he is, Barack Obama refused to call what happened in Armenia from 1915-1923 a genocide, instead 'artfully' finding a middle ground on the issue, much like Chamberlain did when confronted by a similar display of evil. "On this solemn day of remembrance, we pause to recall that ninety-five years ago one of the worst atrocities of the 20th century began," Obama said in a statement.... " It is in all of our interest to see the achievement a full, frank and just acknowledgment of the facts." He then refused to call what took place in Armenia a 'genocide' and mouthed vague words of nothingness to mark the occasion.

The Armenian National Committee of America (ANCA) rapped Obama for "disgraceful capitulation to Turkey's threats" and of "offering euphemisms and evasive terminology to characterize this crime against humanity," in a press release Saturday. I agree.

While it is important to maintain relations with Turkey, and while we badly need their support on a bunch of important subjects, the truth is the truth, and it is black and white. Obama should recognize the truth and quit trying to make everything so grey.

Women's Murder Club Box Set, Volume 2

The 4th of July
In a late-night showdown after a near-fatal chase, San Francisco police lieutenant Lindsay Boxer has to make an instantaneous decision - and sets off a chain of events that leaves a police force disgraced and an entire city divided. As summer comes into full swing, Lindsay and her friends in the Women's Murder Club battle for her life on two fronts: before a judge an jury as her trial comes to a climax, and facing unknown adversaries who will do anything to keep her from the truth.

The 5th Horseman
It is a wild race against time as Lieutenant Lindsay Boxer and the newest member of the Women's Murder Club, attorney Yuki Castellano, lead an investigation into a string of mysterious patient deaths and reveal a hospital administration determined to shield its reputation at all costs. While the hospital wages an explosive court battle that grips the entire nation, the Women's Murder Club hunts for a merciless killer among its esteemed medical staff.

The 6th Target
While Assistant District Attorney Yuki Castellano prepares to prosecute the toughest trial of her life, the city is in the grip of a chilling crime spree. Children of well-to-do families are being abducted. But the kidnappings are followed by devastating silence -no demand for ransom. Working frantically with her new partner, Lindsay Boxer struggles to find the connection that will help them make sense of these horrific crimes.

How "Capone's block anti-graft fight in Africa"

In Reuters:

"If you have an Al Capone as Head of State, an Al Capone as governor of the central bank and Al Capones in every other institution, how can one succeed?" Ribadu said, referring to the American gangster who ran crime syndicates for several decades.
"Unfortunately that is the situation in most African countries today," Ribadu said in a telephone interview from Washington, where he is living in exile and working as a fellow at the Center for Global Development think-tank.
